Parties

This Agreement, effective as of the invoice date, is between American Overhead Garage Door Repair (“Contractor”) and the customer listed on the invoice (“Customer”).

Project Description

The Contractor agrees to provide all necessary labor, equipment, and materials to complete the work described in the invoice titled “SERVICES/MATERIALS.”
If additional space is needed for the project description, it will be provided on attached sheets.

Payment Policy

• A 50% deposit is required before work begins. This deposit is non-refundable and may be charged over the phone.
Full payment is due upon completion of the work.
• Once work has begun or parts have been delivered, the sale is considered final.
• Coupons are valid only at the time of estimate or repair and cannot be combined with other offers.
Accepted payments: Credit cards and checks.
• Returned or cancelled checks will incur a $50 fee.

Non-Payment & Ownership of Materials

Title and ownership of all materials and equipment remain with American Overhead Garage Door Repair until full payment is received.

In the event of non-payment, the Contractor reserves the right to pursue all remedies available under Texas law, including filing a mechanic’s lien or initiating legal action to recover the amount owed.

The Customer agrees to be responsible for all collection costs, including attorney fees. Any delivered but uninstalled materials remain the property of the Contractor and may be reclaimed if payment is not received.

Lien Rights Disclosure

In accordance with Texas law, the Contractor reserves the right to file a mechanic’s lien against the property for unpaid labor, services, or materials.
This lien may affect the title to your property.

Credit Card Transactions

By authorizing payment, the Customer permits the card issuer to process the amount shown on the invoice and acknowledges receipt of goods or services.
All services and parts are non-refundable and due upon completion.
A convenience fee of up to 4% may apply to credit card transactions.

Authorized Work & Property Access

The Customer affirms that they are the property owner or have legal authority to permit the Contractor to perform the services described in this agreement.
Technicians are authorized to act on behalf of American Overhead Garage Door Repair to complete work, collect signatures, and process payments.

Preparation Requirements

The garage area must be cleared at least 10 feet back from the door opening before any installation or service begins.

Warranty Information

Product warranties for motors, doors, and panels are handled directly through the manufacturer and require a valid invoice for verification.

If the Customer has purchased a Limited Warranty Policy from American Overhead Garage Door Repair, the following terms apply:

LIMITED WARRANTY POLICIES (If Purchased)

Availability: Monday–Friday, 9 AM – 5 PM
Service Call Fee: $49 after 30 days from the original service date

Labor Coverage: • Labor not included after 30 days

Exclusions: • Damage to garage contents
• Force adjustments on openers
• Safety sensor realignment issues ($89 fee applies)
• Light bulbs not included

Part Coverage: • Covers part cost only

Void if: • Repairs attempted by third parties
• Invoice not presented at the appointment
• Damage caused by other operators or Acts of God

Usage Policy: Customer must stop using the door immediately and await technician inspection.

Scope: • Covers normal wear only; excludes damage from external impact.
• Non-transferable and non-refundable.

By providing a phone number, the Customer consents to receive service-related and promotional messages from American Overhead Garage Door Repair.
Message and data rates may apply.

Consent to marketing texts is not a condition of service.

Arbitration Agreement

Any dispute arising from this agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Attorney Fees

The prevailing party in any arbitration or legal proceeding is entitled to recover reasonable attorney fees and legal costs.

Governing Law

This Agreement is governed by the laws of the State of Texas.

Acknowledgement

By signing or approving service, the Customer acknowledges and agrees to all terms and conditions stated herein.
